The time of paper March Madness brackets, hand-drawn raffle tickets, and pulling a physical slot machine lever are waning. Today, the gaming industry is rapidly moving online with mobile wagering increasing exponentially. This CLE will prepare participants on how best to advise clients in this space and how to keep their own firms in compliance with state and federal laws when organizing fantasy leagues, sweepstakes, and office pools among employees. In addition, the presenters will discuss where Maine stands on jumping into the booming sports betting and mobile gaming markets. Participants will learn how best to draft and update internal Internet and mobile device usage policies in light of the proliferation of online gaming and how to navigate online office pools. This CLE will also address basic legal requirements for creating and operating sweepstakes and contests online outside of the gaming space, best practices for drafting official rules, and commonly made mistakes when implementing these types of promotions on social media.

Speakers:

Steven Silver (Attorney, Ogletree, Deakins, Nash, Smoak & Stewart, P.C.). Steve is currently Chair of the Maine Gambling Control Board and also maintains a civil practice focusing on ERISA litigation, sports and gaming law, and representing employers in federal and state court litigation involving discrimination, harassment, retaliation, and wrongful termination claims. He also represents employers in administrative hearings and counsels employers on a broad spectrum of day-to-day employment matters, including employee discipline, terminations, leaves of absence, and wage and hour issues. In addition, he assists employers in drafting policies, employee handbooks, and employment-related agreements to ensure compliance with local, state, and federal law. Prior to moving to Maine, Steve practiced in Philadelphia where he defended premises liability, products liability, trucking, and other civil litigation matters. Before his legal career, Steve was a sports reporter for the Tennessean and Las Vegas Sun.

Kasey Boucher (Attorney, Pierce Atwood LLP): Kasey Boucher is an intellectual property attorney at Pierce Atwood who works with clients of all sizes spanning many industries, including sporting goods, footwear and apparel, cosmetics, and food and beverage. She advises clients on various aspects of unfair competition and advertising laws, including sweepstakes and contests. In addition, she represents clients on all aspects of trademark matters as well as the protection, enforcement, and licensing of copyrights. She also advises clients on a wide range of technology transactions.
