Most ethics violations are not the headline grabbing, clearly inappropriate actions that we often think of when we think about ethical practice. Far more often, it is generally upstanding, well meaning attorneys who make a decision in a more "gray" area of ethical considerations and it creates consequences that were neither foreseen nor intended. One way to analyze such decisions is through behavioral economic principles: what are the cognitive biases and heuristics that lead otherwise rational and well meaning people to make poor choices?
